Zoning Board of Appeals
Overview
The Zoning Board of Appeals considers requests ranging from variance requests for minor home improvements and buildable lot approvals to special permit requests for retail expansions on nonconforming uses and structures and extensions of previously approved projects.
The Zoning Board of Appeals is a five member board, appointed by the Selectmen, all of whom shall be residents of the Town of Casco. Members appointed for 3 year term by Selectboard.
The Zoning Board of Appeals shall:
- Hear and decide where it is alleged there is an error in any order, requirement, decision, or determination made by the Code Enforcement Officer in the enforcement of the Zoning Ordinance.
- Hear and decide where it is alleged that there is an error in a decision by the Planning Board under the site plan review provisions in Article 7 of the Zoning Ordinance.
- Review variance appeals for increases in nonconforming nonresidential uses over 25%.
- Hear and decide appeals requesting such variance from the terms of the Zoning Ordinance as will not be contrary to the public interest where, owning to special conditions, a literal enforcement of the provisions of the Zoning Ordinance would result in undue hardship. A variance may be granted only by majority vote of those members present and voting, and may include such conditions and safeguards as are appropriate under the Zoning Ordinance.
